Terms and Conditions

General Terms and Conditions of Mandanten Autopilot GmbH for dismissal-claim.de

1. Provider and scope

The provider is Mandanten Autopilot GmbH, Burggrabenstrasse 12, 8280 Kreuzlingen, Switzerland (UID CHE-354.872.847). These terms apply to all contracts for the creation of an unfair dismissal claim via this website. Deviating terms only apply if we expressly agree to them.

2. Service

The generator is software. It guides you through questions in a chat and uses your answers to create an unfair dismissal claim (Kündigungsschutzklage) as a print-ready document in German. This includes the statement of claim, a copy for the opposing party and instructions in English on how to file the claim with the labour court. You also receive an English translation of the statement of claim and a glossary. The translation is for your information only and is not filed with the court. If the German and the English version differ, the German version applies.

We do not provide legal advice and do not check your case. We do not enter into a contract for legal services with you. The content of the claim is based solely on your answers. The estimate of the severance payment is a rough guide and not a promise about the outcome of any proceedings.

The competent labour court is determined from the postcode of your place of work. Please check this before filing. You have to file the claim yourself. The claim must reach the labour court within three weeks of receiving the written dismissal. You are responsible for meeting this deadline yourself. Proceedings before German courts are conducted in German.

3. Conclusion of the contract

The presentation of the generator is not yet a binding offer. By clicking „Unlock now“ and completing the payment with our payment service provider Stripe, you submit a binding offer. The contract is concluded when we unlock the complete claim for you. The contract language is English. We do not store the contract text separately. You will receive the invoice by email.

4. Price and payment

The price is EUR 99, payable once, including statutory VAT. There is no subscription. Payment is processed by Stripe. The payment methods shown on the payment page are available.

5. Scope of use

One payment entitles you to create one claim for one claimant. After payment, you can correct your answers and have the claim recreated as long as the last name stays the same. To prevent misuse, the number of changes is limited. If you reach the limit, please contact us. The claim is intended for your own legal dispute. Reselling it or using it commercially is not permitted.

6. Right of withdrawal

As a consumer, you have a right of withdrawal. Details can be found in the Cancellation Policy.

7. Defects

The statutory rights in the event of defects apply. If the document is technically faulty, for example if it is not created completely or cannot be printed, please write to us at info@dismissal-claim.de. We will fix the error as quickly as possible.

8. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under mandatory statutory provisions such as the German Product Liability Act.

In the case of slight negligence, we are only liable if we breach an essential contractual obligation, i.e. an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely. In this case, liability is limited to the foreseeable damage typical for this type of contract.

We are not liable for the outcome of the proceedings, for the consequences of incorrect or incomplete information or for late filing of the claim.

9. Data protection

How we handle your data is described in the Privacy Policy.

10. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law only applies insofar as it does not deprive you of the protection of mandatory provisions of the country in which you have your habitual residence.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

Should any provision of these terms be invalid, the remaining provisions shall remain valid.
