We are based in Switzerland and offer our service to people in Germany. The General Data Protection Regulation (GDPR) and the Swiss Federal Act on Data Protection (FADP) therefore apply to us.

2. The most important points in brief

  • We do not use cookies, tracking or advertising pixels on this website.
  • Your answers in the chat stay in your browser until you pay.
  • Only after payment does your browser send your answers to our server so that it can create the complete claim. The content of your claim is not stored there. On request, we send you the claim by email.
  • Payment is processed by Stripe.
  • We count anonymously how often each step of the chat is reached, without cookies and without storing your IP address.

3. Hosting

The website is hosted by ALL-INKL.COM, Neue Medien Münnich, Hauptstraße 68, 02742 Friedersdorf, Germany. The provider processes data on our behalf on servers in Germany. We have concluded a data processing agreement with the provider.

4. Server log files

When you visit the website, the server automatically stores data transmitted by your browser: IP address, date and time, page visited, referrer, browser and operating system. We need this data to operate the website securely and reliably. The legal basis is Art. 6(1)(f) GDPR. The log files are deleted automatically after a short time.

5. Storage in your browser

So that your progress in the chat is not lost, the page stores your answers in the local storage of your browser. This data is not transmitted to us as long as you have not paid. You can delete it with „Start over“ or via your browser settings. This storage is necessary for the function you requested.

6. Creating the claim

After payment, your browser transmits your answers to our server in encrypted form. This includes your name and address, details of your employer, your salary, the length of your employment, details of the dismissal and, if you select them, details of special protection against dismissal such as pregnancy or severe disability. The server uses this to create the claim and the English translation and sends them back to your browser. We do not store the content of the claim.

We only store the reference of your payment, an encrypted check value of your last name and the number of changes. This ensures that one payment is valid for one claim.

The legal basis is the performance of the contract under Art. 6(1)(b) GDPR. Where health data is concerned, we process it because this is necessary for the establishment, exercise or defence of your legal claims (Art. 9(2)(f) GDPR).

7. Payment via Stripe

We process payments via Stripe. The provider for customers in Europe is Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland. On the payment page, you enter your email address, name, address and payment details directly with Stripe. We receive your name, email address, address, the amount and the payment status from Stripe, but not your full card details. Stripe also sends the invoice on our behalf.

Stripe may also process data in the USA. Stripe, Inc. is certified under the EU-US Data Privacy Framework. The legal basis is Art. 6(1)(b) GDPR. You can find more information in Stripe’s privacy policy: stripe.com/privacy.

8. Emails about your order

Immediately after payment, we send an order confirmation with the contract details to the email address you entered with Stripe. We receive a copy of this confirmation for our records. It does not contain the content of your claim.

If you click „Send by email“, our server creates your claim and the English translation as PDF files and sends them to the same address. The PDF files are deleted from the server immediately after sending. We do not receive a copy.

The emails are sent by the mail server of our hosting provider ALL-INKL.COM. The legal basis is the performance of the contract under Art. 6(1)(b) GDPR and, for health information in the claim, Art. 9(2)(f) GDPR.

9. Anonymous usage statistics

To find out at which question people stop using the chat, we count how often each step of the chat is reached on each day. Only these counts are stored. We do not set cookies for this, do not store your IP address, your answers or any identifier, and cannot assign the counts to any person. The legal basis is our legitimate interest in improving the service, Art. 6(1)(f) GDPR.

10. Reminder about the conciliation hearing

Before payment, you can voluntarily tick the box for us to remind you by email about the conciliation hearing, with a checklist and tips on severance pay. For this we use the email address you enter with Stripe. The legal basis is your consent under Art. 6(1)(a) GDPR. You can withdraw your consent at any time with effect for the future, for example via the unsubscribe link in the email or by writing to info@dismissal-claim.de.

11. Contact by email

If you write to us, we process your details in order to answer your enquiry. The legal basis is Art. 6(1)(b) GDPR if your enquiry relates to a contract, otherwise Art. 6(1)(f) GDPR.

12. Storage period

We only store data for as long as necessary for the respective purpose. We keep invoices and accounting records for ten years due to statutory retention obligations. We delete the data for the reminder emails after they have been sent or as soon as you withdraw your consent.

13. Your rights

You have the right to access, rectification, erasure and restriction of processing, the right to data portability and the right to object to processing based on legitimate interests. You can withdraw any consent at any time. To do so, write to info@dismissal-claim.de.

You can lodge a complaint with a data protection supervisory authority, in particular in the EU member state in which you live. In Switzerland, the Federal Data Protection and Information Commissioner (FDPIC) is responsible.

14. Security

The website is encrypted throughout using TLS.
